Definitions

Goods: movable items offered for sale on the Website, including goods containing digital elements

Goods containing digital elements: movable items that incorporate or are connected to digital content or digital services in such a way that without them the goods would not be able to perform their functions

Parties: Seller and Buyer jointly

Compatibility: the ability of goods containing digital elements, digital content, or digital services to function with hardware or software normally used with goods of the same type without the need for conversion

Website: the present website used for concluding contracts

Contract: a sales contract concluded between Seller and Buyer through the Website and electronic communication

Durable medium: any device that enables the consumer or business to store data addressed personally to them in a way accessible for future reference and for a period appropriate to the purpose, and allows unchanged reproduction of the stored data

Means of distance communication: any device enabling the parties to make contractual statements without being physically present at the same time (e.g. forms, standard letters, advertisements with order forms, catalogues, telephone, fax, internet access tools)

Distance contract: a consumer contract concluded within a distance selling system without the simultaneous physical presence of the parties, using only means of distance communication

Business: a person acting within the scope of their profession, independent occupation, or business activity

Buyer/You: the person making a purchase offer and concluding a contract via the Website

Seller: the person offering goods and concluding contracts via the Website

Warranty: in consumer contracts, a warranty provided under the Civil Code, either voluntarily or by law

Purchase price: the consideration payable for the Goods or digital content

Scope of the GTC

The content of the contract between us is governed by these General Terms and Conditions in addition to applicable laws.

They define the rights and obligations of both parties, conditions of contract formation, performance deadlines, delivery and payment terms, liability rules, and conditions for exercising the right of withdrawal.

Technical information necessary for using the Website not included in this GTC is provided elsewhere on the Website.

Language and form of the contract

The language of contracts covered by these GTC is Hungarian.

Contracts are not considered written contracts and are not archived by the Seller.

Electronic invoicing

Our company uses electronic invoicing pursuant to Section 175 of Act CXXVII of 2007. By accepting these GTC, you consent to the use of electronic invoices.

Prices

Prices are in HUF. The Seller is exempt from VAT, therefore prices do not include VAT.

The Seller may modify prices for business reasons; however, this does not affect already concluded contracts.

If an incorrect price is displayed and an order is placed, the Seller will proceed according to the “Procedure for incorrect pricing” section.

Procedure in case of incorrect pricing

Clearly incorrect prices include:

price of 0 HUF
incorrect discounted price (e.g. 1000 HUF item incorrectly shown as 500 HUF instead of 800 HUF with 20% discount)

In such cases, the Seller offers the product at the correct price, and the Buyer may decide whether to proceed with the purchase. If not, no contract is formed.

ENGLISH – Consumer Protection Procedure & Legal Remedies

Consumer Protection Procedure

Complaints may be submitted to consumer protection authorities. If the consumer notices a violation of their consumer rights, they are entitled to file a complaint with the competent consumer protection authority based on their place of residence. After evaluating the complaint, the authority decides whether to initiate consumer protection proceedings. First-instance consumer protection authority tasks are carried out by the competent capital and county government offices according to the consumer’s place of residence; their contact details are as follows:

Court Proceedings

The customer is entitled to enforce claims arising from consumer disputes before a court in civil proceedings in accordance with Act V of 2013 on the Civil Code and Act CXXX of 2016 on Civil Procedure.

Conciliation Board Procedure

If your consumer complaint is rejected, you are entitled to turn to the competent Conciliation Board based on your place of residence or domicile, or the one specified in your request.

The initiation of conciliation proceedings requires that the consumer attempts to settle the dispute directly with the business concerned.

Unless the consumer requests a personal hearing, the conciliation board conducts hearings online via electronic means ensuring simultaneous audio and video transmission.

The business is obliged to cooperate in the conciliation procedure and must submit its response within the deadline set by the board.

Except where EU Regulation 524/2013 applies, the business must ensure the participation of a representative authorized to conclude a settlement.

The Seller has not made a general submission declaration to any conciliation board.

Consumer-Friendly Reviews

We inform Buyers that the Seller uses the “Fogyasztó Barát” review system on the Website.

The system evaluates the Seller (webshop), not individual products.

Technical measures ensure that only real customers can submit reviews:

  • The system operates independently from the webshop; the review widget appears after purchase, and reviews are stored by Fogyasztó Barát (JUTASA Kft.).

  • Reviews can only be submitted via an email sent to the email address provided during purchase.

The webshop has no technical ability to delete reviews.

Therefore, the system contains only genuine customer feedback and displays both positive and negative reviews without distinction.

ENGLISH – Partial Invalidity, Code of Conduct, Ordering Process, Consumer Rights & Warranty

Partial Invalidity, Code of Conduct

If any provision of these Terms and Conditions is legally incomplete or invalid, the remaining provisions of the contract shall remain in force, and the applicable legal regulations shall apply instead of the invalid or defective part.

The Seller does not have a code of conduct under the Act on the Prohibition of Unfair Commercial Practices towards consumers.

Information on the Essential Characteristics of the Products

The essential characteristics of the Products available for purchase on the website are described in the product descriptions for each item.

Correction of Data Entry Errors – Responsibility for the Accuracy of Provided Data

During the ordering process, before finalizing the order, you have the opportunity to continuously modify the data you have entered (by clicking the back button in the browser, the previous page opens, so the entered data can be corrected even if you have already moved to the next page).

Please note that it is your responsibility to ensure that the data you provide is entered accurately, as invoicing and delivery of the Product will be based on the data you have provided.

Please also note that an incorrectly entered email address or a full mailbox may result in the failure of the confirmation delivery and may prevent the conclusion of the contract.

If the Buyer has finalized the order and notices an error in the provided data, they must initiate the modification of the order as soon as possible. The Buyer may notify the Seller of the modification of the incorrect order by sending an email from the email address provided during ordering or by phone.

Use of the Website

Purchases are not subject to registration.

Selecting a Product

By clicking on the product categories on the website, you can select the desired product group and within it the individual Products. By clicking on each Product, you will find its photo, item number, description, and price. In the case of purchase, you must pay the price indicated on the website.

Adding to Cart

After selecting the Product, you can place any number of Products into the cart by clicking the “Add to Cart” button without creating any purchase or payment obligation, as adding to the cart does not constitute an offer.

We recommend placing the Product in the cart even if you are not sure whether you wish to purchase it, as this allows you to easily review and compare your selected Products on a single screen.

The contents of the cart can be freely modified until the order is finalized – until the “Place Order” button is pressed. Items can be removed, new items can be added, and quantities can be changed.

When you add a Product to the cart, a separate window appears with the message “Product added to cart.” If you do not wish to select additional Products, click “Proceed to Cart.” If you wish to view the selected Product again or add more Products, click “Back to Product.”

Viewing the Cart

You can check the contents of your cart at any time by clicking the “View Cart” icon at the top of the website. Here you can remove selected Products or change their quantities. After clicking “Update Cart,” the system displays updated information, including the prices.

If you do not wish to select additional Products, click “Checkout” to proceed.

Providing Customer Data

After clicking the “Checkout” button, the contents of the cart and the total purchase price will be displayed.

In the “Shipping method” section, you can choose between personal pickup or delivery. In case of delivery, the system displays the delivery fee, which must be paid.

In the “User data” section, you can enter your email address, and in the “Billing information” section, your full name, address, and phone number.

The “Shipping information” section automatically stores the billing data; if you wish to use a different address, you must remove the checkmark.

Additional information can be entered in the “Notes” field.

Order Review

After filling in the required fields, you can proceed by clicking “Continue” or return to the cart by clicking “Cancel.”

On the “Order Review” page, you can see all previously entered data summarized, including cart contents, user data, billing and shipping details, and the total amount payable. (These details cannot be modified here unless you go back.)

Finalizing the Order (Making an Offer)

If you confirm that the cart contents and your data are correct, you can finalize your order by clicking “Place Order.”

The information on the website does not constitute a contractual offer by the Seller. In orders under these Terms, you qualify as the offeror.

By clicking “Place Order,” you acknowledge that your offer is binding and may result in a payment obligation upon confirmation by the Seller.

The Seller must confirm receipt of the order electronically without delay. If the confirmation is not received within a reasonable time, but no later than 48 hours, the Buyer is released from the obligation.

Processing Orders and Formation of Contract

Orders can be placed at any time. The Seller confirms the order within 48 hours.

The contract is concluded when the confirmation email becomes accessible in the Buyer’s email system.

Procedure for Uncollected Parcels

If the Buyer fails to collect the ordered Product and does not exercise the right of withdrawal within 14 days, they breach the contract.

In such cases, the Seller may attempt re-delivery (possibly subject to an additional delivery fee).

If re-delivery fails or cannot be arranged, the Seller may terminate the contract with immediate effect and claim the delivery costs as a penalty.

The parties accept email communication as valid, and the termination is considered delivered when accessible in the Buyer’s email account.

Performance Deadline

Unless otherwise agreed, the Seller must deliver the Product without delay, but no later than 30 days after the conclusion of the contract.

Right of Withdrawal

Consumers have the right to withdraw from the contract without justification within 14 calendar days.

The withdrawal period starts from the day the Product is received.

If the Seller fails to inform the consumer properly, the withdrawal period is extended by 12 months.

Obligations of the Seller in Case of Withdrawal

The Seller must refund all payments, including delivery costs, within 14 days of being informed of the withdrawal.

The Seller may withhold the refund until the Product is returned or proof of return is provided.

Obligations of the Consumer

The consumer must return the Product within 14 days and bear the direct cost of return.

The consumer is liable for any depreciation resulting from use beyond what is necessary to establish the nature and functioning of the Product.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in cases specified in Section 29 of Government Decree 45/2014, including customized products, perishable goods, sealed hygiene products, digital content after performance has begun, etc.

Warranty and Guarantee

The Seller is liable for defective performance under statutory warranty rules (implied warranty, product warranty, and guarantee).

Consumers may request repair, replacement, price reduction, or contract termination under the conditions defined by law.

Mandatory guarantee periods:

  • 2 years (10,000–250,000 HUF)

  • 3 years (above 250,000 HUF)

The Seller must strive to complete repairs or replacements within 15 days.

Three-Day Replacement Rule

For durable consumer goods, the consumer may request replacement within 3 working days if the defect prevents proper use.

Limitation of Liability

The Seller is released from warranty obligations only if it proves that the defect occurred after delivery.
